Court of Appeals Affirms Impaired Driving Conviction
On December 26, 2023, the Minnesota Court of Appeals issued its opinion in State v. Orman, a criminal appeal of a second-degree impaired driving conviction, challenging the validity of the stop. Attorney Alina Schwartz of Campbell Knutson, P.A., argued on behalf of the State. The Court of Appeals affirmed the conviction holding that the stop was constitutionally valid because the police officer who stopped Orman reasonably suspected unlawful activity after observing Orman weaving within the traffic lane and speeding.
