The Campbell Knutson litigation team represents the City of Shorewood in an action to remediate a dilapidated building under Minnesota’s hazardous building statute. Despite repeated court orders finding the building to be a hazard to public health and safety requiring its demolition, the owner has refused to take action and cooperate with the City to ensure removal. The owner has instead filed baseless motions seeking to overturn the court’s orders, prolonging litigation and preventing the City from taking important safety measures. To prevent further frivolous litigation, Campbell Knutson attorneys Jack Brooksbank and Jared Shepherd sought and received sanctions against the property owner and their attorney under Minn. R. Civ. P. 11, which prohibits attorneys and parties from bringing meritless arguments in court. This extraordinary remedy is not often granted and is a significant recognition of the time-sensitive nature of the safety issues at stake which necessitated the City filing the action initially.
