On January 27, 2026, the Minnesota Court of Appeals in Dunn v. City of Vadnais Heights dismissed an appeal involving a dispute between neighbors regarding the construction of solar panels on one neighbor’s property. The appellant sued their neighbor who constructed the solar panels, and the City, contesting the grant of two building permits and an electrical permit for the construction of those solar panels and the City’s denial of their administrative appeal of the permits. The Court of Appeals dismissed the case for lack of subject matter jurisdiction, concluding that such appeal could not be brought before the Court of Appeals where an alternative avenue for review in district court pursuant to Minn. Stat. 462.361, subdivision 1 was available to the appellants.
